It’s over for Apple: Supreme Court denies certiorari in e-book pricing case

It’s the end of the line.

I’ve been writing about this literally for years, and it has been a very important story. It’s also been perhaps a tale of unexpected consequences.

First the quick headline, then some thoughts about it.

On Monday, the Supreme Court of the United States denied Apple (and a bunch of other cases) “cert”. What that means is that they did not certify that Apple’s loss at a lower court level in a case brought against it by the United States Department of Justice over e-book pricing deserved additional review.

The lower court’s ruling was clear enough that it didn’t need to be re-examined.

Even simpler: Apple loses.

Consumers will get some credit to buy e-books.

Now, let’s look at the stories within the story.

Apple is vulnerable

The DoJ also went after the biggest U.S. trade (the kinds of books you would have bought in a bookstore…not textbooks and such) publishers…all of which settled.

Apple fought on, and many people figured Apple had the resources to fight on as long as they wanted.

The thought was that Apple is so big, has so much money, and does so many court cases that, unlike the publishers, it was worth it for them to keep pouring money into this.

One again, they lost.

I’m not sure, but it’s possible the vacancy on the Supreme Court affected this. I’ve read that Justice Scalia would likely have supported Apple…and if this needed a majority and it was split (they don’t tell us much when they deny cert), that would have done it.

The tradpubs made a crucial strategic error

Here was the situation:

Amazon entered the very marginal e-book market (Sony was in it, but not much was happening in the USA with e-books) in 2007.

Part of their strategy was to promote that most bestsellers and new releases would be under $10…considerably less than the hardback equivalents (at least based on the publisher’s suggested retail price…but even discounted, those hardbacks were often above $10).

To do that, they clearly often sold the books at a loss: they paid more to the publisher than they got from the customer.

The publishers didn’t like that.

One of  their biggest concerns was “price value perception devaluation”. Who would pay $25 for a hardback when, according to Amazon, $9.99 was the right price for a popular new release novel?

While it does cost somewhat less to produce an e-book than a hardback (an early analysis said it was about 12.5% lower, as I recall…many of the costs, such as editing, lay-out, legal are the same), the margin on hardbacks (the profit you can make) was higher…and they were selling a lot more p-books (paperbooks).

What could they do, though? Realistically, if they wanted to be in the exploding e-book business, they pretty much had to go with, and cooperate with, Amazon, which absolutely dominated the market.

Then, in the tradition of tempting Apples 😉 , the maker of the iPod offered the tradpubs (traditional publishers) a path.

Apple was getting ready to release a new device…a small, flat, super-portable  computer. There were precedents in fiction (Star Trek: The Next Generation’s PADD, for one), but what would become the massively successful iPad was a big project.

The hardware innovator wanted to include books as part of the package and launch. It’s questionable if they really were that focused on the books in and of themselves, or whether they saw them more as a selling point for the device. If Apple hadn’t been introducing the iPad, would they ever have launched the iBooks store?

They wanted to get  the prestige of having the major publishers onboard, and they knew those companies weren’t happy with Amazon.

Apple offered to let the publishers set the prices the consumers paid (within certain parameters) through something called the “Agency Model”.

The Agency Model is not, in and of itself, illegal. The DoJ alleged that Apple and the tradpubs coordinated in its use to raise e-book prices…that was the problem.

In my opinion, the tradpubs made a very big error.

They accepted the plan, and raised  e-book prices on the most popular titles.

Why was it a mistake?

I’m seeing so many stories reporting this as it slowing the growth of the e-book market…perhaps critically wounding it.

I don’t think that’s what happened at all.

What it did was cede the market, in large part, to indies (independent publishers).

Indies had a very hard time having much of an impact on p-book sales. I was the manager of a brick-and-mortar bookstore…it just wasn’t practical for us to carry independently published books, for the most part. They didn’t have the resources to make selling their books practical. If I needed 100 copies in two days, they couldn’t do it, for example.

E-books changed all that.

You didn’t need book factories and distribution Godzillas. You didn’t have to fight for shelf space…it was pretty much infinite.

Indie e-book sales were present before the Agency Model came into being in 2010, but I think that move by the publishers and Apples greatly accelerated the market growth for the “outsiders”.

When I did an analysis of USA Kindle store bestsellers in January 2012, three of the top twenty them were from indies:

Top 20 analysis January 22 2012

When I did a similar analysis in January of this year, the story was different: none of the top ten were from Big 5 publishers.

None of the top 10 bestselling USA Kindle store books are from the Big 5

That’s not exactly apples to apples (so to speak), but it seems very clear to me.

At least at Amazon, the Big 5 share of the market for bestsellers has significantly eroded.

I think the tradpubs thought that raising e-book prices would mean that they would make more money…because people would keep buying their books at the same rate.

Instead, many readers instead discovered other options…and they’ve stuck with them.

You can’t undo that discovery.

The news stories reporting e-book slowed growth are actually reporting the Association of American Publishers reporting slowed growth…which might be more than offset by indies (although those stats are hard to get).

I think the publishers may also have wanted to “teach Amazon a lesson”. They did: they taught Amazon that the e-tailer could do its own publishing, at least for e-books, and do very well. 😉 Brick-and-mortar bookstores didn’t, for the most part, want to carry Amazon’s p-books, but in e-books, they are often at the top of Amazon’s bestseller list (thanks in part to Kindle First books (at AmazonSmile*)).

It’s about journalism

This case would have been very different without journalism.

Journalist Walt Mossberg was chatting with Steve Jobs at the iPad launch…and Jobs said that e-book prices would be the same at the then launching iBooks store and Amazon.

All Things Digital post by Kara Swisher

That was major evidence against Apple.

I think it’s also important to note that, while Mossberg had mainstream credentials, this was much more a new media incident. It wasn’t a sit down interview. It wasn’t even an ambush interview at Apple’s front door. It was a casual exchange which was recorded on a handheld, shaky Flip cam (remember those?), and then posted online.

You can watch the video (the e-book exchange is right at the beginning) in that Kara Swisher post (I’m relinking for those using screen readers: All Things Digital post by Kara Swisher).

I think those are the three main stories. It’s possible the pay-out to we consumers will boost the e-book business…we’ll get a credit to buy more e-books, as I understand it, not cash.

While this has been an important story, and I’m happy to have been able to provide whatever help to people in understanding it and its implications that I could, I won’t deny some relief in seeing its conclusion.

What do you think? Have questions? Do you think this was a good decision? How does it affect the future of e-books? Feel free to tell me and my readers what you think by commenting on this post.

5 useful Amazon Kindle Help Pages

Amazon has been working on their Help Pages, and I do think they’ve made some improvements. The pages now tend to have clearer step by steps, videos, and the rules which might impact what you are trying to do. If you don’t find the answer you need, feel free to ask or you can go to

http://www.amazon.com/kindlesupport

There are several ways to contact them, but I usually have them call me. My phone will ring in seconds and I’m typically speaking to someone in under a minute.

Okay, here are some useful pages:

Open eBooks now available to connect students with free e-books

March 6, 2016

Open eBooks now available to connect students with free e-books

I said years ago that I thought the traditional publishers would participate in making e-books available to those of lesser means on a needs-tested basis.

Those tradpubs used to donate p-books (paperbooks) a lot…it was one of the reasons why, when I was the manager of a brick-and-mortar bookstore, we couldn’t donate the “strips”.

What’s a “strip”?

When a brick-and-mortar buys a book from most large publishers, they are guaranteed that they can sell it. If they don’t sell it, they can get credit from the publisher to purchase other books.

Naturally, you had to prove you didn’t sell it.

You could mail the whole book back, but that’s expensive…so we would tear the covers off paperbacks and send them back in an envelope.

Well, my employees would do it…I really had a hard time emotionally with tearing a book apart like that.

After you tear the cover off, you still have a book you can read. I wanted to donate them to local organizations, but I was told we couldn’t do that. However, we could simply identify the organization to the publisher, and generally, they would donate books to them (I think they had to have the right tax status, but I’m not sure).

Since tradpubs did that, I figured they would do needs-tested licensing of e-books…they aren’t losing sales to someone who couldn’t afford the book otherwise.

We haven’t really seen that with the general public through public libraries or directly through the publishers, but I was excited to see an initiative start up for students.

WhiteHouse.gov blogpost by R. David Edelman, Special Assistant to the President for Economic and Technology Policy

explains the program, and as an introductory video by Michelle Obama.

It’s probably important to note that this isn’t a government program…it was “…created by a breakthrough coalition of literacy, library, publishing, and technology organizations who worked together over the past year to make the initiative possible.”

Baker & Taylor, a major book distributor, is involved…but so are ten (so far) tradpubs:

  • Bloomsbury: Providing unlimited access to over 1,000 of its most popular titles.
  • Candlewick: Providing unlimited access to all relevant children’s and young-adult eBook titles in their catalog.
  • Cricket Media: Offering full digital access to all of its market-leading magazines for children and young adults, including Ladybug and Cricket.
  • Hachette: Offering access to a robust catalog of their popular and award-winning titles.
  • HarperCollins: Providing a vast selection of their award-winning and popular titles.
  • Lee & Low: Providing unlimited access to over 700 titles from this leading independent publisher of multicultural books.
  • Macmillan: Providing unlimited access to all of the K-12 age-appropriate titles in their catalog of approximately 2,500 books.
  • National Geographic: Providing unlimited access to all of their age-appropriate content.
  • Penguin Random House: Committing to provide an extensive offering of their popular and award-winning books.
  • Simon & Schuster: Providing access to their entire e-catalog of books for children ages 4-14, comprised of 3,000 titles.

As you can see, that includes all of the Big 5 largest US trade publishers.

There is a lot of information available at the official site:

http://openebooks.net/

The basic workflow is that “…Any adult who works in a Title I (or Title I eligible) school, or a program or library that serves at least 70% of children from in-need families” signs up, and is then provided codes for their students.

The students can each have up to ten books out at a time, and keep them as long as they want…which is similar to Amazon’s paid subscription service,

Kindle Unlimited (at AmazonSmile: benefit a non-profit of your choice by shopping*)

That’s pretty much it. 🙂

Some people wonder about the children being able to access the books…do lower-income children actually have access to devices on which to read the books?

Some devices are donated, but I thought this was a fascinating statistic in the WhiteHouse.gov post:

“According to a national survey, 85 percent of families with young children (6-13 years old) living below the poverty line have access to mobile devices.”

Amazing!

When the Kindle was first introduced in 2007, it cost about $400.

This doesn’t say that they actually own them, just that they have access to them. It does show, though, how important and mainstream they’ve become.

With a $50 device, and access to Wi-Fi (and there a lot of places to find that for free), the family could have TV, e-mail, a homework resource, and more.

Now, thanks to this program, they can probably also have access to in-copyright e-books.

Meanwhile, at Barnes & Noble: NOOK books out of UK, financials are “in the groove” (of vinyl records)

March 4, 2016

Meanwhile, at Barnes & Noble: NOOK books out of UK, financials are “in the groove” (of vinyl records)

NOOK Bookstore is no more for the UK

I have readers in the UK (and in many other countries…hello, world!) and I have readers who use NOOKs (B&N has been inconsistent with the capitalization).

That’s one reason I wanted to share this

BBC Technology post

However, it’s also instructive for e-book users everywhere.

According to the post, Barnes & Noble is discontinuing their NOOK E-book store in the UK on March 15th …(there is something about that date…the Ides of March and all. “Et tu, B&N?”).

You won’t be able to buy NOOK books in the UK through the website, the Android app, or on your NOOK devices.

Before the end of May, you’ll have to follow instructions to migrate the books on your account for which you have already paid in order to be able to keep them.

Migrate them where?

B&N is working with supermarket Sainsbury’s.

That’s the instructive part.

I’ve said many times that I think the odds are higher that my descendants will have access to my Kindle store books than to my roughly 10,000 p-books (paperbooks).

I’ve been asked, when I say that, what happens if Amazon goes under?

I find that a pretty unlikely scenario. I like their corporate philosophy of Price, Discount, Service, and I think they are making some growth-oriented (and sustainability-oriented) moves generally.

If they did, though, I’ve suggested that someone else would buy our accounts. They would be very valuable. That doesn’t mean that everything would be the same…we might start paying for storage, for example.

This case, though, does appear to illustrate that.

I don’t expect Sainsbury’s to start selling e-books, although they might, and they might partner with somebody.

If they don’t, how do they make the money to pay for storing and managing the books?

Ads, perhaps? An annual fee? Not sure…

“Books? Oh, yeah, I think we still have some…”

Speaking of Barnes & Noble, they just had 3rd quarter financial results reported.

press release

It wasn’t good, but it was less bad in some areas.

So, do literature lovers have reason to cheer the nation’s largest bookstore?

Well, if you count coloring books… 😉

As was made clear in this

New York Times post by Alexandra Alter

B&N’s loss offsetting gains came in things like toys and games…and vinyl records.

Are they on their way to becoming a booklessstore? 😉

The post goes on to talk about the relative strength in independent bookstores. I agree with that. Barnes & Noble has been contracting. Indie bookstores have been growing.

The article also says, “The company’s results come at a time when bookstores may be making a comeback and e-books, which have been perceived as print killers, are losing popularity.”

That second statement is one I would like to see defended…and not by the stats they quote from the Association of American Publishers.

My guess is that more e-books are being  sold…it’s just that AAP-reporting publishers may have a diminishing percentage of that market.

Indie publishers, and Amazon’s traditional publishing, may be growing rapidly enough to reduce the tradpubs (traditional publishers) share.

I also wanted to note that Barnes & Noble lost a lot less on the NOOK this time…but I think that’s not because the NOOK is rebounding, but because it is getting towards the bottom of bleeding out. The less you have, the less you have to lose. Let’s say that you have 100 units of something. It falls off 50%, so you’ve lost 50 units…that sounds terrible. If you continue to lose 50% a year, it only takes three more years before your loss is less than ten units a year (100 to 50 to 25 to 12.5 to 6). So, you could report, by counting your losses (not the percentage), that your loss rate in the last year (you lost 6) is much better than that first year when you lost 50…you only had 12% of the loss. It doesn’t change the trend, though.

Will B&N drop NOOK books in the USA?

I don’t see that happening right away…when they came into the USA, the market was more fluid than it was when they came into the UK. That enabled the NOOK to gain a stronger market share in the USA than in the UK.

If they do make that decision, though, I do think someone would be likely to buy the accounts (Kobo might be a suitor, but it also might be just an investment group of some kind).

Is the loss of the NOOK books in the UK good or bad for Kindle owners?

I think it’s bad…I like competition, it tends to drive innovation.

Not terrible, and not surprising, but I don’t think it’s a benefit.

I expect B&N to stick around, but with fewer books in them until they become like vinyl records…

What do you think? What’s the future of B&N in the USA? Do you worry about what could happen with your Kindle books in the future? How does the presence of NOOK books in the USA affect Kindle owners? Feel free to tell me and my readers by commenting on this post.

Monthly Kindle Deals for $3.99 or less each: March 2016

March 3, 2016

Monthly Kindle Deals for $3.99 or less each: March 2016

Amazon does the Kindle Daily Deal (at AmazonSmile…benefit a non-profit of your choice by shopping*), which used to discount four books a day (often general fiction, a romance, a science fiction/fantasy book, and a kids’ book). Now, it seems like it is generally more books than that, and not categorized.

They also do Monthly Kindle Book Deals for $3.99 or less each (at AmazonSmile). There used to be about 100 of them, but there are ten times that now: 339 at the time of writing…about a quarter of the number in January. They are up to 85% off…but in a return to form, none of them are more than the normal $3.99 top limit.

Those prices only apply to the USA, and one weird thing is that some of the books seem to sell out at that price sometimes (or become unavailable for some other reason).

Another thing is that 134 f them are available through

Kindle Unlimited (at AmazonSmile: benefit a non-profit of your choice by shopping*)

Amazon lists that information prominently…and it’s now commonly a filter in search results. If they are, then you need to consider whether it is worth buying them…even at these low prices. While they are in KU, you can, if you are a subscriber (and there’s a free month available right now), read them at no additional cost. There are, of course, advantages to owning books, especially if you want to re-read them. A book could move out of KU at any time. Even if you think you want to own it, if you are a KU member, you could always read it first to make sure. 😉 I will mark them with KU.

By the way, in the new version of the

eReaderIQ advanced search

you can make KU a filter. So, you can search for books by an author, a keyword, an average customer review which you can read as part of your KU membership…nice! I’m not associated with eReaderIQ except as a user (we have had some correspondence), but I do think it is the most valuable website for Kindleers.

I’m going to list some of the books in this sale that caught my eye…I’m not necessarily recommending them, but I do think they are interesting.

The ones I link (if I actually link to specific books) also don’t block text-to-speech access**…but I think blocking it is becoming rarer.

The one thing for you that is different is that you pick a non-profit the first time you go (which you can change whenever you want)…and the good feeling you’ll get. :) Shop ’til you help! :) By the way, it’s been interesting lately to see Amazon remind me to “start at AmazonSmile” if I check a link on the original Amazon site. I do buy from AmazonSmile, but I have a lot of stored links I use to check for things.

** A Kindle with text-to-speech can read any text downloaded to it…unless that access is blocked by the publisher inserting code into the file to prevent it. That’s why you can have the device read personal documents to you (I’ve done that). I believe that this sort of access blocking disproportionately disadvantages the disabled, although I also believe it is legal (provided that there is at least one accessible version of each e-book available, however, that one can require a certification of disability). For that reason, I don’t deliberately link to books which block TTS access here (although it may happen accidentally, particularly if the access is blocked after I’ve linked it). I do believe this is a personal decision, and there  are legitimate arguments for purchasing those books.

Today (March 2nd) is Read Across America Day

March 2, 2016

Today (March 2nd) is Read Across America Day

Today is the NEA’s (National Education Association’s) Read Across America Day!

Official Site

This is an event…actually, lots and lots of events, focused on children reading, and especially on reading to children.

You can even pledge to do your own event at the site above.

I was interested to see that there are also events taking place outside the USA (Hong Kong; Alexandria, Egypt; Minsk, Belarus…), although they seem to focus on English-speaking and perhaps American students.

Why March 2nd?

It’s the birthday of

Dr. Seuss (at AmazonSmile: benefit a non-profit of your choice by shopping*)

I would suggest that Theodor Geisel (birth name) may be one of the most influential authors to get children into the fun of reading.

Certainly, the rhyming helps…it makes it possible to memorize an entire book before you can read it, which makes it easier to then associate the words with the sounds (since you know which words go with which pictures and pages).

However, I think it’s also important that not everything is happy in a Seussical world.

There are real conflicts and concerns. There is even social commentary.

The Cat in the Hat is certainly not the sort of completely even-keeled, happy, conformist type of character that some people think exemplifies children’s literature.

The Cat is a rebel. Even though there is a voice of reason (in a fish bowl) arguing against the mischief, it’s there.

Green Eggs and Ham is all about a conflict.

I think having real emotions, and real reactions to events, helps the Dr. Seuss books resonate with children (and other humans). 🙂

I recently got for my birthday and read

Dorothy of Oz (at AmazonSmile*)

by Roger S. Baum, the great-grandson of L. Frank Baum.

I’m a big Oz fan, and I really appreciated getting the book (I actually got a hardback as a collector’s item, and then bought the above Kindle version to read).

However, it didn’t feel very much like my beloved Oz books, despite having a pretty good knowledge of the points of fact from the originals.

One of the biggest things that stood out to me is that there was really no conflict between the “heroes”.

In the originals, the Tin Man, the Scarecrow, the Cowardly Lion, and Dorothy often have conflicts of opinion. They have to at least talk out their different points of view. They respect each other, certainly, and they are really friends…but that doesn’t mean they instantly agree on everything all the time.

Roger S. Baum’s version doesn’t have that…it appears that being a good person means that you agree with all of the other good people all of the time.

That’s not the world Dr. Seuss shows us…

Lest I be taken for a dogmatic Zax, though, I can understand people wanting to read conflict-free books to their kids…this just wasn’t a good tonal match for the Baum (or Ruth Plumly Thompson, for that matter) books.

That’s one of the great things about reading! Every book is a way to see the world from a different viewpoint than yours, which I think is one of the most valuable things in the world.

Enjoy Read Across America (and the world) Day!

What do you think? Are you involved in any events today? Does conflict belong in children’s books? Feel free to tell me and my readers what you think by commenting on this post.

Snapshot: March 1, 2016

I generally run this information through eReaderIQ.com (it’s just easier than Amazon), and there are some vagaries in the searches (both there and on Amazon). I do try to run it the same way every time, so unless Amazon changes something, it should give you a pretty good idea.  NOTE: I’ve changed this explanation from saying “Jungle-Search.com” to “eReaderIQ.com”. It’s the same people and I assume the results are the same. eReaderIQ is just for the Kindle, Jungle-Search does Amazon generally. eReaderIQ has a slightly better interface for the searches.

* There was also an enhanced audio/visual version of this book for $16.99. I chose to enter it here only in the standard version, since that most closely represents the comparison between paper and e-book versions. It isn’t necessary to pay $16.99: it’s an additional payment for more features

Summary

Generally, this was a good month. Prices overall looked good. There was more content, and more free books to borrow and own. The New York Times bestseller hardback fiction equivalents did go up in average price, though. The dichotomy there is likely due in part to the bestseller equivalents being tradpubbed (traditionally published) for the most part, while books in the Kindle store increasingly is not.

Older data were drawn using http://www.jungle-search.com, newer data with http://www.ereaderiq.com (from the same people). There are a number of possible sources of errors (eRi, Amazon, me), but these are probably pretty good.

  • The free books referenced here are from the Kindle store: there are many other sources for free books
  • My search for textbooks definitely has false positives (books that aren’t really textbooks). I search for -domain (to eliminate public domain titles, which would be older books, generally) textbook. That would find a book about textbooks, for example
  • I searched for “Spanish edition” to find Spanish language books. That has some false positives as well
  • I look at price percentages of books in the range of one penny to fifty dollars, to eliminate freebies and limit textbooks
  • The price point analysis is for books at that specific price: it does not represent a range of prices
  • I compared the percentage of price points in the Price Point Analysis when I showed the difference…not the number of books
  • This information is based on what a United States customer sees

Just published! The Measured Circle’s Geek Time Trip!

February 29, 2016

Just published! The Measured Circle’s Geek Time Trip

This is one of the very rare cases where I’m publishing basically the same post here and in another blog of mine, The Measured Circle. I thought it was worth putting both places, and I thought you’d be interested. One of the things in this project is linking to books (or Goodreads and other pages). I’m thinking you’ll notice one difference right away in my writing below…I use the editorial “we”). 😉 I don’t know why I started that at TMC: I don’t do it here in ILMK…

We are very excited to announce the publication today (Leap Day) of a new project,

The Measured Circle’s Geek Time Trip

at The History Project!

You’ll be able to learn about (and in many cases, read/watch/listen to) geek friendly content.

To introduce it, I’m going to do what I call a “splinterview”: I’m going to interview myself about the project. As with all of my splinterviews, I haven’t thought about what I’m going to say ahead of time, and won’t substantively edit it afterwards (if I catch typos, I’ll correct those…just like I would with an interview with someone else).

Let’s get started!

Q. Your new project, The Measured Circle’s Geek Time Trip was published. What is it? A book, a blog…?

A. Well, it’s something different. It’s really more of a timeline, but much more interactive than that usually means.

Q. What do you mean by interactive?

A. When people use it, they’ll often be able to click on a link to watch a movie or TV show, read a book, listen to a radio show, that sort of thing.

Q. Will they pay for that?

A. Not me [laughs]. In many cases, I’m linking to public domain sources where there is no charge at all, but it’s possible they’ll see ads there. In others, I may link to a place that helps them find something where they might be paying. For example, for in-copyright movies & TV shows, I typically link to JustWatch.com, which is a search engine for streaming services. It might show them that they can watch the movie at Amazon Prime or Netflix or Hulu, for example. The user may be paying a monthly fee for that, but they won’t pay more for watching this specific movie.

Q. What about books? Are you only linking to subscription services there?

A. I generally link to Goodreads, which does have links where you can buy books. I’m not opposed to people buying things, even if that has become increasingly unpopular. What I don’t want to do is only link people to a single place to buy something. I don’t want it to feel like an ad, like I’m trying to sell them something.

Q. So, you aren’t making money on the Geek Time Trip?

A. Not directly. I did get permission from The History Project to link to my The Measured Circle blog, for example. It’s possible somebody will go from TMCGTT to The Measured Circle, and then do something there which might result in me getting some money.

Q. TMCGTT?

A. The Measured Circle’s Geek Time Trip.

Q. You mentioned getting permission from The History Project. Describe your relationship with them, and what they are.

A. Well, “getting permission” sounds too strong, really. I think everybody has that permission [to link to their websites]…I just asked them and they let me know it was okay. I’m not really connected with them, I’ve just had some correspondence with them as a user. What happened was that I’d heard about them…they’ve gotten some mainstream publicity. I think I first saw it in a Flipboard story. Anyway, I made a timeline for a relative as a birthday present. They happened to contact me for user feedback, and I said quite a bit [laughs]. I had a couple of conversations with them, mostly by e-mail. While they do seem like a startup, although a solid one, it seemed like a good place to do something public, and that they would (knock wood) be around for a while.

Q. What makes them seem like a startup?

A. Oh, there are some interface things, for example, that I expect to mature over time. I also see them making incremental improvements. I can feel the energy, enthusiasm, and commitment that can go with being a startup.

Q. Why do you think they’ll be a lasting company?

A. I mentioned the mainstream publicity…Forbes, CNN, to name two. I can tell that they know what they are doing from the website. Getting that coverage and having something that works technically is a good combination…it suggests both funding and some expertise, and at least some popular resonance for the idea.

Q. That’s probably enough background; let’s talk about what people will see when they go to The Measured Circle’s Geek Time Trip.

A. Sorry, one more thing first. There was a hiccup early on…I asked a question through the website, and didn’t get an answer. I’m big on Customer Service, and that made me hesitant even to do the birthday present. I could see that some big people were using it, like Jewel, so I decided to go ahead. When I brought that up in my user feedback, which I think was just a random thing, I got a personal and very strong and satisfying response. They apologized, and explained what happened, and made it right. Nobody gets everything right all the time…what matters is how you deal with your errors.

Q. And you were satisfied?

A. Yes.

Q. Okay. So, what will be the experience for someone going to the Geek Time Trip?

A. It’s a timeline, first. They’ll see events on a chronological line.

Q. What sort of events?

A. Oh, when an actor or author is born, when a movie was released, when a book was published…something specific that happened. They can then click on that event, and that’s where I would say this starts getting really useful and fun. Visitors will find links to the content, but also to references…Wikia entries, YouTube and Google news searches, lots of things.

Q. Wikipedia?

A. Wikia…although I did Wikipedia sometimes, too. Wikia is really a fan-based site, with many wikis for different  properties.

Q. Were you always able to find links to the content?

A. No. I link when I can, but I don’t want to exclude something just because I can’t link to an online option.

Q. How do you choose what to put into The Geek Time Trip?

A. In this early stage, it’s a bit random. I could literally list thousands of items I’d like to have in TMCGTT offhand, with no research. I think that having the content is a good thing, one of the attractions. So, I’ve been going through some sites that have content, getting things there, and then rotating in other things I want to mention.

Q. Do you mind saying what sites?

A. Not at all! I name them in TMCGTT. I want them to get credit for the hard work they’ve done, and I want to drive people to the sites. For example, I use The Digital Comic Museum. That’s a great site! You can read or download public domain comics there, often obscure.

Q. How do you know they are public domain, not in copyright?

A. That’s a great question! I can’t know for sure…in many cases, it’s hard to research a copyright. What I do is get a sense of whether or not I think the site make a good faith effort to protect people’s rights. I do know something about copyright, as a layperson. I write about it fairly often in my most popular blog, I Love My Kindle.  I care a lot about copyright, so I’ll do what I can to get that right.

Q. How long does it take you to create an entry?

A. That’s one of the things. It takes a few minutes, I’d say. I do some research, put in the links…I’ll look for an unusual site. I would have loved to have thousands of entries on go live day, but there just wasn’t time.

Q. You are busy, right? Two blogs, books, and you have a full time job?

A. Three blogs, actually, but who’s counting? [laughs]

Q. I Love My Kindle, The Measured Circle, and?

A. 221B Blog Street. That doesn’t take me much time, though…I just republish the original public domain Sherlock Holmes material, either a chapter or a short story a day, in order. I just like having serialized literature available, which is the way many things we now consider classics were published…and Holmes is great!

Q. How do you have time to add another big project like The Geek Time Trip? Won’t your other projects suffer?

A. I can’t say there will be absolutely no impact, but things have changed. I haven’t really worked intently on a book for some time…ILMK takes up the vast majority of my writing time and energy, and that will continue to be the case. In the past couple of years, I’ve had another change which is helping…I only sleep about four and a half to five and half hours a night. That was a weird big change: I went suddenly from going to sleep by nine and waking up at five, which is eight hours, to waking up between 1:30 and 2:30 AM.

Q. That’s very early!

A. Yes, and somehow, it takes me six hours to get ready for work in the morning! [laughs] Not really, but I do exercise and get writing done. My baseline for exercise is ninety minutes a day, although I generally do more.

Q. Aren’t people supposed to get eight hours sleep?

A. I’ve actually checked with my doctor on it…twice. My doctor thinks it is okay…different people need different amounts of sleep. I don’t fall asleep during the day, and in my job, if I had cognitive decline, I’d know it.

Q. What is your job?

A. I’m a trainer. I work with medical people, so I’m pretty in tune with what’s risky behavior. I wouldn’t mind getting more sleep, but I don’t miss it and seem to be doing fine.

Q. Let’s get back to the Time Trip. When you pick events, what kind of impact do you want them to have on people?

A. I want different reactions. I want to waken lost memories…have somebody say, “I remember that!” I want people to be surprised when they encounter something they had no idea existed…and to hopefully enjoy it, of course. I’d also like it to be useful…I can see someone looking something up on it, and returning to the same event to check the Google news search link.

Q. How often will you add things?

A. I figure I’ll add a few things a week, and then have some binges sometimes where I do more.

Q. Do you have any help?

A. I wouldn’t mind that in the future. Right now, the moderation tools at The History Project aren’t robust enough for me to just open it up to everybody. I need to be able to review something, to make sure it isn’t just advertising, wildly inaccurate, or inconsistent with what else is there. Some of what I’m doing could be done pretty easily, at least basically adding an event…those public domain comics at DCM  don’t take a whole lot of decision making, outside of picking the comics. For now, it’s going to be just me. That doesn’t mean I don’t want suggestions or corrections, though! I’ve set up a page where people can comment to do just that, The Measured Circle’s Geek Time Trip. Even at go live, I had Samurai Pizza Cats, which was suggested to me by someone in the family.

Q. How will you measure the success of The Measured Circle’s Geek Time Trip?

A. If I have fun doing it and have the time, I’ll probably keep it going. I’d be encouraged if I hear from people that they like it. I would love for it to get mentioned in more mainstream sources…I’ve been a subscriber to Entertainment Weekly for many years, and appearing there would be fun. Getting mentioned in The Mary Sue would also be a measure of success for me. If it brings more people to my other works, great. The main thing, though, is people getting something out of it…that’s what makes me the happiest.

Q. Anything else you want to say?

A. Just that I’ve been having fun with it! There has definitely been some trial and error, and I found some techniques and style which helped. I’ve done a little bit of writing in it, but I’ve been keeping my opinions out of the entries. I just hope it’s a trip people find worth taking.
